§ 2-27.5. Workmen's compensation; parish government risk management agency.
(a)
The parishes signing the agreement authorized by Ordinance No. 772 and all other parishes which may subsequently join and be accepted, hereby form and agree to participate in an agency which initially shall provide a group self-insurance fund for workmen's compensation and employer liability protection for their employees. The parishes which are parties to the agreement shall be known collectively as the Parish Government Risk Management Agency (hereinafter referred to as the "agency").
(b)
The fund created by the agency shall be separate as to risk and shall be maintained by the agency as a separate pool.
(c)
It is agreed that the affairs of the agency and funds created through the participation of the members of the agency shall be administered by the Parish Government Risk Management Agency with the Police Jury Association of Louisiana, Inc., as overall administrator of the agency pursuant to a contract with the agency which will provide for duties and compensation.
(d)
Pursuant to the statute referred to above, the executive board of the Police Jury Association of Louisiana, Inc., shall constitute the board of trustees of the agency. The board of trustees of the agency shall adopt, operate and enforce rules, regulations and bylaws of the agency.
(e)
The board of trustees may admit as members of the agency only acceptable governmental entities of the State of Louisiana which have common government interests. The trustees shall be the sole judge of whether or not an applicant shall be admitted to membership. A member may be suspended or expelled from the agency after thirty (30) days from the date of mailing of notice to be expelled or suspended to the member and no liability shall accrue to the agency as a result of any accident involving an employee of the suspended or expelled member occurring more than thirty (30) days after the mailing of such notice.
(f)
Pursuant to the statutory authorization cited above, the members of the agency hereby agree to contribute the share of funds as set forth in their joinder application to establish, administer and maintain funds to pay the costs of defense of claims, and the expenses of administration. The contribution shall be determined by the board of trustees as to the particular group self-insurance fund specified in each member's joinder application. However, no member shall be liable to the agency or to one another or to any claimant of the members of the agency except for payment of the contributions provided for in the accepted joinder application for a particular group self-insurance fund.
(g)
This agency shall not be effective as to risk sharing unless and until it has received approved joinder applications requiring the payment of at least two hundred thousand dollars ($200,000.00) in annual member contributions and the commissioner of insurance has issued a certificate of authority to the agency pursuant to Louisiana statutes.
