§ 9-43. Operation of vehicles in landfill site.
(a)
Generally. Webster Parish owns, operates and maintains sanitary landfills for the disposal of garbage, trash, tires and other refuse, by individual households, nonprofit organizations, school systems, and public agencies, and authorized commercial haulers and commercial users, in accordance with the state department of natural resources, solid waste division.
(b)
Unlawful operation of vehicles in landfill site.
(1)
No person shall drive a vehicle on any road or other part of the Webster Parish landfill at a speed greater than is reasonable and prudent under the conditions and potential hazards then existing, having due regard for the traffic, the width and conditions of the road or passage, the operations of the landfill and the landfill contractor, and the weather, and in no event at a speed in excess of the maximum speeds established by this section.
(2)
The speed limit of motor vehicles on the landfill roads or within the landfill site shall be fifteen (15) miles per hour, and it shall be unlawful for any person to drive or operate a motor vehicle in excess of such limits.
(3)
The Webster Parish Police Jury authorizes the operator of the landfill to designate temporary, reasonable and safe maximum speed limits on areas of the landfill that are under construction or in a state such that operation at the normal speed is a hazard to occupants of vehicles and others in the same area.
(4)
No person shall drive or operate a motor vehicle on any area or portion of the landfill where operation of motor vehicles has been restricted or prohibited by signs, tape, barriers, or barricades unless that person is an employee of the parish or the contractor operating the landfill or unless that person has obtained permission from the parish or contractor's personnel to enter that area.
(c)
It shall be unlawful for any operator of any vehicle to exceed the provisions of this section. In the event that such operator of a vehicle shall violate the provisions of this section, the operator of the vehicle may be fined up to one hundred fifty dollars ($150.00) and costs of court and/or be incarcerated for a period not to exceed thirty (30) days.
