§ 4-18. Penalty.

  • (a)

    Any person violating any provision of this [article] or who sells any alcoholic liquor as defined in [this article] otherwise than when prescribed by a licensed physician as a medicine, within the limits of [the areas] of Webster Parish, Louisiana [described in section 4-15], shall be guilty of a misdemeanor and upon conviction shall be punished by a fine not exceeding five hundred dollars ($500.00) and by imprisonment not exceeding six (6) months or both fine and imprisonment at the discretion of the court with an additional imprisonment according to law upon failure to pay the fine.

    (b)

    Where it is contended in any prosecution for the violation of this [article] that any such liquors were prescribed and sold as a medicine, it shall be for the court to decide whether such prescription and sale were made in good faith and in case of sickness, or as a mere subterfuge and with intent to evade the provisions of [this article].
