§ 21-43. Denial, revocation, alteration, or suspension; appeal.

  • (a)

    Should the Webster Parish Communications District Board disapprove or deny an application for an ambulance operator license, the applicant shall be notified by certified mail of that determination and the reasons therefore. The applicant may appeal the Webster Parish Communications District Board's denial action by submitting a written appeal to the Webster Parish Police Jury within thirty (30) days after the date of the notice of the denial. The police jury shall hold a hearing to consider the appeal within thirty (30) days after the filing of the appeal. The police jury shall thereafter make a decision on the disposition of same, which shall be binding on all parties, subject to their rights of judicial appeal.

    (b)

    In addition to the general penalties imposed for violation of the provisions of this article, the Webster Parish Communications District Board is authorized to suspend, alter, or revoke any license issued under this article when it determines there has been a failure by a holder of a license to comply with the requirements, rules, regulations, and standards adopted herein; provided that the Webster Parish Communications District Board shall, by certified mail, furnish the licensee not less than ten (10) days' written notice of the proposed action and the reason(s) for the suspension or revocation of the license, and shall offer the licensee the opportunity to request and participate in a hearing before the board to discuss the proposed action prior to its effective date. Said written notice shall require the licensee to request in writing that such a hearing be conducted. The Webster Parish Communications District Board shall notify the licensee in writing of its findings after the hearing.

    (c)

    Any person whose license has been suspended, altered, revoked may, within thirty (30) days from the date of the notice of suspension, alteration, or revocation, appeal to the Webster Parish Police Jury. Such appeal shall suspend the effects of the Webster Parish Communications District Board's action pending the rendering of a decision by the police jury. The decision of the police jury shall be binding on all parties to the appeal, subject to their rights of judicial appeal.
