§ 9-40. Hold harmless requirement.

  • Any person entering upon a parish operated landfill for any purpose shall be conclusively presumed to know and appreciate the hazards which accompany the accumulation of scrap wood, glass, nails, trash, brush, household waste and solid waste of every description and to know the danger inherent in the use of trucks and heavy machinery to move, remove, bury, and dispose of said accumulation. Therefore, every person entering upon any landfill shall be conclusively presumed to have assumed the risk of any injury connected with entry into said landfill site. In consideration for the permission to enter such site granted by the parish police jury, every person shall agree and be deemed to have agreed not to sue the parish police jury and to indemnify, hold harmless, and defend the police jury, its members, officers and employees from and against any and all claims of any nature whatsoever for injury or damage to person or property whether real or asserted, arising out of or resulting from the entry of such person upon any parish operated landfill.
