§ 2-7. Operation of jail—Generally.

  • (a)

    The sheriff or his legal deputies shall attend at the opening of the jail or any door or trapdoor thereof and also to the closing of the same and shall attend personally to the locking up of the prisoners.

    (b)

    Each prisoner shall be inspected by the sheriff or his deputies whenever they deem it necessary for their safekeeping.

    (c)

    Whenever any prisoner charged with a crime punishable with death is confined in the jail and it is deemed necessary by the sheriff and district judge, the sheriff shall cause a guard to be placed in jail or in the neighborhood of the jail, whose duty it will be to stop by any means justifiable every prisoner attempting to escape. For this guard the sheriff shall be allowed one dollar and fifty cents ($1.50) for every day's service for each guard. (Ord. of 5-17-1895)

    (d)

    Pursuant to the authority of L.R.S. 33:1432, the sheriff of Webster Parish shall be paid the sum of three dollars ($3.00) per diem for the keeping and feeding in the parish jail of each prisoner legally incarcerated by the sheriff; provided, however, that the per diem allowance above set forth shall not be paid by the police jury for prisoners of the respective municipalities of the parish which utilize the parish jail.

    Editor's note— Act No. 478, Legislature of Louisiana, approved August 1, 1976, § 1 provided for keeping and feeding of prisoners in jail not less than three dollars ($3.00) per diem for each prisoner. Section 2-7 of this Code has been changed from one dollar and fifty cents to three dollars to reflect the new legislative provision.

    (e)

    The sheriff of Webster Parish is hereby authorized and directed to charge to and collect from each respective municipality the per diem allowance for each prisoner incarcerated in the parish jail for or on behalf of, or under the authority of the respective municipality within the parish.
