§ 3. Appointment of notaries public; qualifications; bond, etc.

  • (a)

    The Governor of this state shall, by and with the advice and consent of the Senate and upon a certificate of competency granted by the Twenty-Sixth Judicial District Court of Louisiana, as hereafter provided, make the necessary appointment of notaries public for the Parishes of Bossier and Webster, respectively.

    (b)

    Any citizen of the state over twenty-one (21) years of age, a qualified elector in and a resident of the Parish of Bossier, or the Parish of Webster, for at least two (2) years next preceding his appointment, being of good moral character, integrity, competency and sober habits, may be appointed under the provisions of this act, a notary public in and for the parish in which he resides, upon giving bond with one or more good and solvent sureties, in the sum of one thousand dollars ($1,000.00) subscribed in favor of the Governor of the state, and conditioned as the law directs for the faithful performance and discharge of his duties as a notary public, which bond shall be approved by the president of the police jury for the parish in which he resides and recorded in a special book kept for that purpose in the conveyance office for the parish in which he resides. Upon complying with the requirements of this act, such appointment for life shall be during good behavior. Failure to keep the required bond in effect shall subject any such notary to suspension.

    (c)

    Every applicant for a commission as notary public for either the Parish of Bossier or the Parish of Webster shall apply to the Twenty-Sixth Judicial District Court for the parish in which he resides and shall furnish a certificate establishing his citizenship, residence and good reputation, sworn to and subscribed by at least two (2) reputable citizens of said parish. Said court, pursuant to the rules thereof adopted for such purpose, shall cause said applicant to be examined by a committee of lawyers appointed by said court and, if found competent and possessed of the necessary qualifications, the court shall issue to the applicant appropriate certificate signed by a judge of said court.

    (d)

    Commissions as notaries public for Bossier Parish or Webster Parish issued prior to the effective date of this act shall remain in effect.

    (e)

    Actions against sureties on said bonds shall prescribe in ten (10) years from date of act of commission or omission.
